Initiating an employment complaint in California

Everything about a new job usually looks so promising in the beginning. You may have sought out and applied for a position that interested you and for which you were qualified. You made it through the interview process and, finally, you were offered and accepted the job. At this stage, many people feel like the hardest part - the finding and securing of the job - is probably done. Unfortunately, as many of the clients we have worked with over the years could tell you, this is not always the case.

Former employee files whistleblower claim against telecom firm

The main goal of most companies in California is to make as much money as possible. Most go about this in a legal way and simply use marketing and advertising to boost sales. However, not all companies follow the legal ways of promoting a business and will resort to potentially illegal tactics to boost sales or gain an edge on the competition. When this occurs, employees within the company may be asked to participate in the illegal activity. However, these employees do not have an obligation to do this and can refuse to do so.

Signs that one may be the victim of sex discrimination

People in California go to work each day and do their job to earn income for themselves and their families. Some people also go to work with the expectation that if they do a good job and put in their time for their company, they will be able to move up or use their experience to gain a better position at a different company. However, some people have found that it is harder for them to do this than others.

Ways one can be wrongfully terminated

Most employees in California are at-will employees. This means they do not have a contract that states they will be employed for a certain length of time. It also means they can quit at any time and do not need a reason. This type of freedom means that employers can also fire employees at almost any time for almost any reason and not violate the law. However, there are some limitations on what employers are allowed to do.

Reporting off-label promotion of pharmaceuticals

There are many different medications that are prescribed to patients in California. There are also new medications being created and tested every day. It is important that these new medications be safe for the people taking them. Every new medication must go through rigorous testing and must ultimately be certified by the Food and Drug Administration prior to being marketed and sold to doctors and hospitals.

Settlement in prevailing wage case

In recent news, 103 California construction workers received $7,228 each after a Long Beach labor commissioner learned that San Diego subcontractor, Champion Construction was committing prevailing wage fraud. Their general contractor, TB Penick & Sons, were also held liable. The guilty parties settled 1.1 million.

Prominent biologist resigns amid sexual harassment allegations

Throughout the #metoo movement many people in California have been accused of sexually harassment. Some were more surprising than others, but what the movement has demonstrated is that sexual harassment is prevalent in workplaces throughout the state. The harassment was not limited to just certain industries or types of work. People in entertainment received the most publicity, but the government was exposed, the tech industry and many others as well.

How companies discriminate through disparate impact policies

Companies in California have various job requirements for certain positions. They could require a certain level of education, job experience, flexibility with work hours and many other types of requirements. These job requirements are applied to every worker who is either trying to get hired or be promoted. On the surface, these requirements seem fair and it is assumed that everyone will be treated the same.

Transgender workers face many obstacles in the workplace

People's gender, gender identification, race, age does not affect their ability to do their jobs in California. However, despite this fact, there are many employers who seem to think it does and discriminate against various classes of individuals based on this belief. This is illegal though and there many different laws protecting employees from discrimination. These laws include transgender individuals as well, which is a group that faces gender harassment, discrimination and high unemployment rates.

Protecting employees who report Medi-Cal fraud by employers

Medical treatment in California can be very expensive, especially for those who cannot afford to pay for private health insurance. Medical bills for procedures and surgeries can add up quickly and medications are also very expensive. However, they are also necessary for many people. In order to help people who need the medical treatment, but cannot afford it, these individuals may qualify for Medi-Cal to pay for these costs.
