Protecting employees from whistleblower retaliation

People in California have many different types of jobs and work for a variety of different employers. Each company run their businesses differently, but no matter how they want to run it, every company must follow the law and regulations. Not all companies follow these laws though and some even force their employees to participate in the illegal activity. Many of these employees may not want to engage in this illegal activity, but may feel like they do not have a choice if they want to keep their jobs.

This puts these employees in a very difficult position especially since they rely on their jobs to support themselves and their families. To help encourage employees to report their employers' illegal activities, if they do report the activity, they are protected from whistleblower retaliation.

There are many different laws and regulations that employers may be breaking as well. It could be fraud involving government contracts, Medicare or Medicaid fraud, pharmaceutical fraud, violating transportation, environmental, health and safety, labor and other industry violations. If an employee reports a violation or refuses to participate in the activity the employer cannot retaliate against them for doing so.

The retaliation can include more than just being terminated from employment. The retaliation could be a demotion, a pay deduction, a failure to promote, a poor performance review, public humiliation or other detrimental actions. If the employer retaliates, the employee may be entitled to compensation or reinstatement to their job or former position depending on the circumstances.

Most employers in California follow the laws, but there are many who will try to make extra money by violating them. Employees are encouraged to report these violations to the appropriate authorities and if they do, the employers cannot retaliate against them.
