What can be done if people are terminated because of their age?

One fact of life is that people in California will continue to grow older. There is no way around that fact. As people age, physically they may feel different and may experience other changes. However, most of the time these differences do not eliminate their need to work and earn an income. Also, most of the time people are perfectly capable of working as they grow older.

Women cannot be treated differently because of pregnancy

How women feel during a pregnancy can vary quite a bit, but some women have very difficult pregnancies. During these pregnancies the women may have significant physical issues or there may be issues that develop that can significantly harm the baby.

Trump says LGBT job bias laws don't include transgenders

In an unsolicited move that seems to have taken many people by surprise, the Trump administration's Justice Department has weighed in on a private employment federal case involving the alleged discrimination and firing of a gay employee based on his sexual orientation. This somewhat unusual involvement came on the same day that President Trump announced his intention to ban transgender individuals from serving in the military via a series of three tweets on Twitter.

The most common employer violations that lead to lawsuits

There are a surprising number of misguided decisions that can put an employer in violation of employment laws. While some of these decisions may have been made with genuinely good intentions, there are others that can reflect the kind of carelessness, corner-cutting measures, and general unfamiliarity with the basics of employment law that can eventually result in lawsuits. If you are an employee who feels as though workplace violations are being committed by your employer, it may be in your best interest to speak to an attorney experienced in employment law, who can help you determine if violations are in fact occurring and how to right them.

What is California's whistleblower law?

Whistleblowers face risk but have legal protections. California law encourages employees to notify the appropriate government agency where their employer is violating any federal, state or local law or regulation. California also prohibits whistleblower retaliation against these employees.

California agency sued over wrongful termination

For a California public agency, a recent wrongful termination lawsuit is only one of its legal problems and evidence that government is not immune from employment law problems. A former administrative law judge at the California Public Utilities Commission filed a wrongful termination lawsuit earlier this month alleging that the agency engaged in whistleblower retaliation and racial bias.

University of California sexual harassment conduct is widespread

There has been a growing concern lately regarding both the surprising frequency and the subsequent handling of sexual misconduct, sexual harassment and sexual assault cases at university campuses across the state. This wider focus on allegations of sexual misconduct and the disciplinary measures taken by university administrators throughout the 10 campus system in California was sparked following a series of high profile cases of sexual harassment which came to light at UC Berkeley in 2015.

EEOC says Estee Lauder's parental leave policy is discriminatory

The cosmetics company Estee Lauder provides biological mothers, adoptive mothers and primary caregivers a generous benefits package. It includes six weeks of paid leave with a back-to-work rule that provides additional flexibility for up to four weeks. The six weeks of paid leave are in addition to paid leave mothers are given to recover from childbirth -- they are meant for child bonding.
