Ulta Stores Hit with Labor Employment Law Class Action Suit in California for Failure to Pay Overtime

A class action lawsuit was recently filed against ULTA Salon, Cosmetics & Fragrance, Inc. (ULTA). The complaint alleges that salon and store managers are improperly classified as exempt from overtime pay according to the California labor code due to the fact that the majority of tasks performed by the plaintiffs are non-managerial.

The lawsuit claims that ULTA allocates insufficient staff hours to each of its stores while still requiring managers to perform sales, customer service, stocking and cleaning tasks. The plaintiffs and class members are also misclassified as exempt because the majority of their working hours were spent performing the same non-managerial tasks as non-exempt employees like cashiers and stock associates.

In addition to that, the lawsuit claims that store managers "work long hours, and often skip their meal and rest breaks, without receiving any overtime compensation or compensation for missed meal and rest breaks."

Under California labor law, employees who are classified as hourly are entitled to overtime pay for any hours worked beyond eight hours per day or 40 hours per week. But, employees who fall into a certain salary threshold and employees who take on management roles are classified as exempt from overtime.

Unfortunately, in many cases, employers try to skirt around overtime pay laws and California wage and hour laws by falsely classifying their employees as managers when they still perform non-managerial tasks that hourly employees also perform.

The lead plaintiffs in the California labor employment law class action lawsuit are three former California store managers, Jaimie Quinby, Linda Gomes, and Eric Fontes.

The case is Quinby et al. v. ULTA Salon, Cosmetics & Fragrance, Inc., Case No. 3:15-cv-04099, in the US District Court, Northern District of California.
