An Important Update to Transgender Employee Rights

If you are a transgender employee in the state of California, you are protected from employment discrimination and harassment under California's Fair Employment and Housing Act. Although the definitions and approaches to transgender employee washroom rights are still being wrestled with by California lawmakers, a decision released in March of 2014 by the Superior Court of California, County of Sacramento, stated that California transgender employees have the right to use gender-identity appropriate washroom and changing room facilities. Other states have enacted similar updates to their own laws, but many states have yet to make as much progress as California.

That's where the Federal government and OSHA have stepped in, publishing A Guide to Restroom Access for Transgender Workers on June 1, 2015. The guide is in place to assure all workers, including transgender employees, have access to restrooms corresponding to their gender identity while still allowing employers to provide safe working conditions.

The new OSHA guideline is a big step in allowing transgender workers to feel more comfortable with who they are at work without fear of workplace retaliation, discrimination, or harassment. While this is only one small step towards reducing workplace issues that transgender employees face, it is still progress in protecting all employees from discriminatory and harassing behavior in the workplace.
